The parties agree that Seller need not further object to any specific terms and conditions set by Buyer; such failure to object to Buyer’s specific terms and conditions is not an acceptance of any such terms and conditions (and consequently Article 682 of the Polish Civil Code does not apply). Subject to sections 2 and 3 of these Terms, the Parties expressly exclude the statutory warranty (rękojmia za wady) under Article 556 and following of the Polish Civil Code. The obligation to “indemnify and hold harmless” included in this section shall mean the obligation of Buyer to cover any damage, costs and expenses suffered or incurred by Seller and pay the relevant amounts to Seller as well as to release Seller from any liability towards third parties (Article 392 of the Polish Civil Code).
